Yes. A writ of summon is notice that they have filed a small claims case against you for an obligation you supposedly owe them. Do you owe the debt? If not, get your evidence together and fight it in court, probably with an attorney. If it is, you can still negotiate a settlement or option to pay so you can avoid court and inevitable judgement. Just be sure to get any offer IN WRITING. Be sure to attend the court date in either case to get on record for any agreement or disagreement. Again, consultant an attorney so you can best protect your rights.

Writ of Summon will be issued if you have defaulted payments for few months. It is advisable for you to talk to the banks / lawyers. However, be prepared as they will ask you to make certain amount of payment before they can come up with an instalment plan. I was issued writ of summon before and after negotiation, they allow me to pay $150 per month. Until few months if I continue to pay in time, they will waive the late charges and interest.

So talk to your bank / lawyers.
