I'm going to be 16 on dec. Last year, my mom(US citizen) applied for my immigrat visa and it was granted. i went to USA last aug.. while im there, they process my green card,but due to a presonal problem, i was unable to wait for my greencard so i went back after 2 weeks in my country with my dad(not US sitizen) but my green card is still on the process. now, after 2 months, my mom recived my green card in the usa.
But my question is, how can i go back in usa? because my immigrant visa is expired and my green card is still in usa. is it be possible if my mom will send my green card here in my country so i can use it to go back there this comming december?or it is not valid to use my green card(first time)or as a port of entry here in my country because i was unable to wait for it while im in the USA, i havent use it and if she just send it to me by mail? is it possible?? what might happend?
i just wana know before we do any steps.
please i desperately need an answer.

Your mother can mail your card to you and you can use it, as long as you have not been out of the US for one year.

You said that your mother applied for your immigrant visa last year, and you went to the US "last August." If you mean 2006, then just get your card and use it to enter the US. If you mean 2005, though, you have been out for more than a year so you might have lost your residency.

If you HAVE been out for more than a year but it wasn't your fault, you can apply for an SB-1 Returning Resident visa at the same consulate where you got your original immigrant visa. If you can convince them that your return to your own country and your staying there for so long was not your fault, and you couldn;t have gone back to the US any sooner, then they may decide to give you an SB-1 visa and you can go again.

Technically, you are not supposed to leave the country while you are waiting for your Green Card. But you did, and they granted you the card anyway.

Have her FedEx the Green Card to you, and use it when you come back to America. There should be no problem, once they have issued you a Green Card you can come and go as you wish, until it expires.

if your mom is an american citizen, then you have dual citizenship and you as a child can come to be with your mother without a green card
The Immigration Act of 1790

The Act also establishes the United States citizenship of children of citizens, born abroad, without the need for naturalization, "the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens".

Have your mother contact immigration here in the USA and see if she can find out for sure. I don't know. But, looks to me like you should be able to use the GC to come back into the USA. Good luck, kid.
