one Wensday me and my wife was drive down the road and some kid hit so in a newr car and we have a 1990 Dodge Omni the air bag came out in the omni but not the newer car every one was ok when we got hit but come to find out last night my wife went to the D.C and they told her she had a brokeing foot and that she has to take 6 to 8 weeks off work and she is a nurce Aid is thier any why she could sue them for some $ note the kid hit us and both cars are total please kelp

Ok, your question is so hard to follow I don't even know where to start, but let's try:

If the other person is at fault you don't "sue" them, you make a claim against their liability coverage for the injury she sustained. They will get her medical records, evaluate the claim, and make a settlement offer when her treatment is complete. You didn't say what happened in the accident, and I know you realize that the determination of fault isn't who hit who, but who caused the accident. From your previous questions it sounds like the insurance for the other person has agreed to pay and your vehicle is a total.

So, knowing all that, she just needs to contact them and let them know she is hurt and what's wrong and they'll explain the process from there. Talk to them, not us, about how this is handled. They'll tell you the straight word.

If you're going to keep asking questions about your Omni and this accident, could you proofread them and use spell check? It's hard to figure out what you're asking.

Go to the police station that responded to the accident, and get a copy of the accident report. Take the accident report to your insurance company and give them any additional information they might need and let them handle it from there. Do not talk to the other person except to give him your insurance information if he asks. Do not discuss it with anyone except your insurance agent.

If u have insurance they should pay the bill if the kid has insurance then his insurance should pay the bill. I hope this helps ...good luck....=)
