Try shoo-ing it away or maybe there is a repellant for birds. I'm not really sure. The bird could have a nest there so do not kill it because it might have a family. If it does have a nest and there are no eggs in there you can move the nest. Do not harm the bird

When you party all night or make noise in the woods, should the animals kill you. Of course you shouldn't kiil it. You should be happy that a bird has chosen you to hear its song. However, depending on where you live it may not be a bird. You could have a frog or an insect that is serenading you and not a bird.

Of course not. You might want to consider discouraging the bird from choosing that tree. Hang tinfoil pie plates in the tree. That might discourage him from sticking around. If he is unsure what it is, he may not come back.
