Did he enter the US illegally or enter legally and overstay? Big difference. You definitely need the help of a good immigration lawyer either way, though. Some couples I know of, in the same circumstances as yours, got married, by a J.P. (didn't tell anyone) and continued with the planning of their wedding. The longer you are legally married the stronger your position. Good luck.
Forgot to say, if he leaves the country a single man, having overstayed or entered illegally, he will be stopped by immigration if he tries to re-enter. You have a stronger argument if you are married and the longer you are married the better.

I want to address two issues. 1.-Does she currently lives in Texas or she is in Mexico? 2.-If you stated she is an Undocumented from Mexico. You must contact a lawyer to advise you on your case. On Dec 2000 were an amendment to the Immigration law 245I who's overstay in the Country undocumented will suffered a penalty of $ 1,000 and 10 years of non permanence in U.S. Only the people who filed the petition within the 245I can be protected from deportation or adjustment of status. Marriage can not only give you an opportunity to change her status but it will a possibility to a deportation if you are not consulting an Immigration Lawyer. Marriage do not provide automatic citizenship. After you marriage you must applied for change her status and wait for 3 months. currently from 6 to 12 months do to the backlog. Then she will receive an status change as a resident permanent. Good luck..

I suggest that you speak to an immigration lawyer, the paperwork is a little hard to understand and if you mess up, you can set yourself back months! The councultation is free and confidential, your fiance will have to return to their country of origin for at least 5 mos. you can go with them or stay here. The lawyer will explain more. There's a good chance you're getting scammed into this. Break off the engagement and see what happens; he/she may well find another in about 30 seconds. If that happens, just call INS on the bum.

This person needs to leave US and enter legally, through a tourist visa and then get married....If you go with a fiancee visa, it takes twice as long...Check with INS though....
