MY 4 BROTHERS ARE INCARCERATED AND CANNOT SIGN THESE CHECKS AND WE WERE TOLD TO GET POWER OF ATTORNEY SO WE COULD BE ABLE TO CASH THEM.CAN WE OPEN A BANK ACCOUNT FOR THEM WITHOUT I.D. OR WHAT ELSE CAN BE DONE?

I would open a bank account in there name but first ask the bank if it can be done with out them and get power of attorney i would not tell them until they are on there way out less they know it best because they will be bothering you all the time to bring them money for this and that

You should probably talk to a bank representative to see how you can legally "hold" these checks for your brothers that are incarcerated.

When my father passed, he had specifically written how his retirement funds were to be dispersed and it just so happened that my brother that was incarcerated was not on the list, so we didn't have to worry about that.

You should check with a paralegal (they are cheaper than lawyers) to see what you should do on their behalf. You should be able to open individual accounts for each brother (without their IDs, but in their name - a lawyer can certainly do that for you as one did for our brother once the rest of the estate was executed).
