I would not bother with the 3 apples because so far you have gotten 10xs the problem. If your neighbor wanted to be really bothersome he could charge you for having your apple tree overlapping his yard thus leaving no room for the sun to hit his grass then he could charge you seed to re sod, a rental fee for the tree overlapping his yard - catch the drift, - when will it end if you don't stop the insanity now.
Just out of curiosity why did you ask for the 3 apples back? If they rotted and he threw them out then I fail to see the difficulty in which this has caused or is their more to this story than what we have read?
When in doubt reverse the situation and see how you would react, you might find your response and the best way to handle this situation. good luck kat

According to a website I found you would have a hard time in court.
"If my neighbor's apple tree extends into my yard, can I eat the fruit? The fruit of a tree belongs to the owner. Although laws are UNCLEAR about fallen fruit, a landowner cannot pick fruit from a neighbor's tree. 'Neighbors also cannot prune branches in order to get the fruit,' Elmendorf says."
The best way to keep your neighbor from eating your apples is to prune the part of the tree that hangs over his yard.
Honestly, why would you care about your neighbor having a few apples? There must be more to the story than this. Otherwise you must be an incredibly petty - person. I would recommend that you find something else to care about! If you didn't want people to talk badly about you, you shouldn't have behaved in such a selfish way.

Honey, you are totally overreacting. They were three apples, get over it. Is a neighbor-feud really worth 72 cents? No, you cannot sue him. It will cost you at least $200 to file a complaint--that's not worth 72 cents. Plus sending him an invoice does sound a little crazy.

Actually, you do sound like you have some sort of instability to demand payment and obsess over three apples that fell into his yard ... or at the very least you sound petty. I'm not trying to be mean or make a diagnosis, I'm just making a comparison. My neighbor obsesses about other people's leaves blowing into her yard and she takes the leaves and puts them in the yard of the houses the leaves came from. She's bipolar. Have you ever thought about seeing a doctor to be evaluated?

I have a neighbor who has a walnut tree and I get a ton of walnuts but I also get the shade in the summer. Why would anybody cause this kind of trouble with a neighbor and why would he go to the store to carry this out? It ake it you two are retired and have nothing better to do. I'd cut the tree down and that would be the end of it. You are very wrong!

I'm surprised your neighbor hasn't posted a question stating he has a problem with YOU. Let me tell you, even if you move to a house that has an apple tree in the middle of your yard and no one but you has access to it's precious apples, you would still find a problem with your neighbor. The problem lies with you, look inside yourself before it gets out of hand and you make lots of enemies and lead and unhappy life.

Why would you sue someone for $.72??? That is the stupidest thing I have ever heard! That is what is wrong with the justice system today; People think they need to sue someone everytime they look cross-eyed at them! I would call you crazy too if you came to me and said I owed you for a few rotten apples! Sounds like you need to get a hobby and leave your neighbor alone!

How is it that your neighbor is guilty of slander or defamation of character and why would you spend hundreds to sue for $0.72?
Furthermore, life's too short to sweat the small stuff, and let's face it, that's REALLY small stuff. Give it up and don't worry about losing a few apples. Enjoy each day for the gift that it is! :)

I believe if they fell on his side the apples belong to him.
I don't thing .72cents is worth the hassle. You can sue for anything but you don't have much of a case.
I think I would just stay away from this person. It sounds as if things have gotten petty and it's probably best to just stay away from him.

Sounds a little childish to me... Actually if your tree hangs over onto his property he can trim those limbs that are doing so .So.. If only a few apples falls on to his lawn LET IT BE! he can keep his yard clean and you still have the tree in whole.. Get my point??
