In 2002 during summer work in the States I got arrested for a minor assault charge - but went back home instead of going to court. My brother is getting married in the States next year and I want to go over - it's a different state - but am worried that they might somehow know about the warrant. What are the chances of them having details in a different state - and what would happen if they did have it on record?

Would be going into Phoenix. I know I should have stayed around before but I just panicked - was told would probably get a fine but was scared of anything worse so took the easy option. Would take the risk if I knew the worse that could happen would be to pay a fine or even get sent back.

I don't know exactly what would happen, but I cannot believe that with today's security and information systems you would get into the USA, unless it were to be taken back to court. I wouldn't want my country to let in somebody who had skipped court either.

You are being given various differing advice. Therefore I think that if you want to go to the United States again you should find a United States lawyer practising in Europe to seek advice, and if necessary make any approaches to authority. I wouldn't contact the embassy or anybody else in authority direct before receiving such advice. I imagine that a local lawyer (or in the United Kingdom perhaps the Citizens Advice Bureau) would point you to a specialist lawyer.

The last thing you want to do is go to the wedding (if that is possible) with the fear hanging over you that you may be arrested or turned away at the airport (which I understand is not at all pleasant).

I do not have much, if any, sympathy for people who deliberately defy the law - it is not a spur of the moment thing like a "minor assault". However, I fear that in today's climate people can suffer excessively for youthful stupidities particularly when it comes to international travel.

P.S. Goldengal's advice seems on the ball to me.

Well.
It's doubtful they would have the info in a different state. And if they did, they would arrest you. The other state would then have 3 days to come pick you up. On a minor assault charge....I'm not sure they would.

P.s. Stop beating people up

It probaably is on record. And if it was for assault you should probably pay the fine and stop running. The fine shouldn't be that much to make it worth hide from the law. They probably know you left the states in the first place.

Try to contact the courthouse that processed the charge. Work out a plea bargain or something. Are you absolutely sure that you needed to show up at court? Maybe they simply entered a default judgment against you, and all that remains is an outstanding penalty fee.

Contact the state that arrested you for the MINOR assault charge. If you want to do the right thing, I'm sure you'll need to answer to those charges.

They will put you in a cell and force you to eat doughnuts until you are fat enough to be passed of as an American citizen. They will then dress you in over sized dungarees and red checked flannel shirt. You will also have to wear a trucker cap which says I love America on it. Once this is completed they will allow you to enter the States.

My husband is a Police Officer & he just told me the answer. You will be arrested upon arrival, at the custom & immigration check cuz ur profile will show & u will be taken to immigration detention, then to the Cops & will have to serve ur sentence in the States, then deported. His advice to u is stay home or visit our jail here.

any cops who tell you you will be arrested are lying...they don't know. most can't be bothered for such a minor offence, unlessthey are bored stiff.

Federal offence carries from state to state, misdemeanour only in the state where it was committed. But remember with today's technology, who knows what they will finds out. If you were caught your @rse ain't gonna be a virgin anymore, if you get my drift.
