My fiance's baby mother side swipped my car this week. The police were called and she took them on a high speed chase. The officer took pictures of the damage and told me that within 2-3 days there would be a report filed. He gave me a case number. I called both insurance companies and have claim numbers. I called today to give the police more information and there are telling me there is no report of the incident and the incident that occured at my address was only a threat. Not true at all! She has called my phone telling me that she will pay for the damage and to lie to the insurance companies that I don't know what happened. My insurance company is now telling me I have to pay a $500 deductible and they will send her a letter, but there is no guarantee I will be reimbursed because it was an intentional hit.

I would start with the watch commander. Give him the particulars officer's name if you have it and the case number. I can't imagine that they went on a high speed chase and didn't write a report. Also take pics if you haven't already. After all is said and done you can sue her in small claims to get the deductible from her.

There are a bunch of issues going on. The first issue is whether or not you really want a police report on the hit and run. As your insurance company indicated, the claim could be denied as being an intentional act on her part.

If she is cooperating then you may just want to file with her insurer, not yours. If she is not being cooperative, I would call back the police and insist that an accident report be filled for the hit and run. If it happened on private property then they may or may not take the report. If they refused, go to the top and insist on at least a complaint being written if not the motor vehicle report. You will need something to file criminal charges against her.

I would personally not file a claim against my policy since doing so has serious consequences these days, especially if you have a "claim history."

I would file the criminal charges against the women until she pays up. Then you can always drop the charges when she does. That will get her motivated to pay. If it doesn't, then file the civil suit for damages against her personally and her insurer and leave yours out of it. You don't necessarily need an attorney. Either way you would be shelling out about $500 for the deductable or the civil suit.

Sounds like the mother is jealous and will go at any cause to cause u troubles.
It is best to have no contact with this person at all.
She is probably in deep creek from the high speed chase.
Her insurance company should cover your car, not yours.
It is best to go to the clerks office in your town and get a hit and run warrant issued.
Have pics of your car to prove it.
Dont give this girl any power what so ever, go on your own instinct.
Get a peace bond on her if she tries to cause you troubles.
If any way u two do remain friends , then let her pay for the car out of her pocket. A car is just a material object, your life isnt.

Ok this is veries from state to state but for the most part you always have to pay the deductible. In order for her to have to pay it you can either A) take her to small claims court. or B) take her insurance company to court. I would do A because the chances of wining against the insurance companys isnt good.
So I would find out where to file small claims in your area last time I went it was like 42 dollars so it will cost you alittle but do the math.

Yes I agree with Robin. And if she is a Mother and was on a high speed chase was the baby with her? She needed to be arrested for child endangerment and the kid be taken away from her. and be placed with the father aka your fiance.
