I am looking for information on immigration laws in regards to children. My sister had a baby with a man who is an illegal alien and he is trying to take the baby away from her. I was just wondering if anyone had any personal experience with this or knew of any websites with information. I already used Google, but did not get anything worthwhile. Again, please only serious answers!! Thanks in advance for your help!!

She was born here and the baby was born here. I guess he swam the river or something from mexico a couple of years ago (I'm not being funny) I am just worried that he will take the baby and run. She is not immigrating to anywhere, just wants the baby safe.

Your sister was with a man who believes that children belong to the father because of the social structure of his home country. She needs to make sure she has all custody of the child and should report the father to INS. If he gets that child to Mexico you and she will never see it again. Is his name on the childs birth certificate? If so she needs to get clear custody because if not the Mexican govt. will never help her get the child should he run with it. People on here saying it is kidnapping and it is but Mexico does not look at it that way if he is the father they consider that the child is his and he should have it. They do not consider it kidnapping if the person is a parent of the missing child.

Do they live in the USA? Actually immigration law would have nothing to do with it. What you need to look at is state law. In a custody battle, thejudge will be looking at the best interesto f the child. He will look at all factors. Certainly, the factor that he is here illegally and deportable at any time weighs heavily against him. Unless he can prove she is an unfit mother, unlikely he will get custody. Shared custody maybe, visitation rights most likely.
In order for a child to get a passport, he needs the consent of both parents. But if she is worried that he may want to kidnap the baby and take it to his homecountry, then she should bring the case before a judge and try to get sole custody of the baby as soon as possible.

It sounds like he wants to keep the baby so it can become his anchor here in the USA. He'll never get legal custody, but if your sister is stupid enough to let him have the baby for a visit it's likely he'll take off with it and she'll never see the baby again. Mexicans don't respect our laws or they wouldn't be here illegally in the first place.

The laws here in the U.S. are in place to protect American citizens. The baby is an American, have your sis call INS and have to sh!thead picked up and tossed back across the border. Your baby is safe, your sister on the other hand should buy a 12-guage and make a citizens arrest. --- and by the way, stop screwing beaners!

I'm a U.S.Citizen and I'm married to an illegal immigrant and we have a 3 year old son (which is a U.S.Citizen) and I would never let him take my son from me and I know the courts would never let that happen. I live my husband and all, but if he ever tried to take my son I would kick his *** myself, besides I don't think they can do that if they're here illegally.Good luck.

If this child was born in the US, True Soul is absolutely right. You should also report the father to INS in order to make sure your sister's chances of keeping the child are optimal.

I can find you some links, But what i think you should do, is call the police or INS and have them deport him,
If he has ever taken your sisters child without her knowledge this is what is classified as kidnapping.
See the police, He has no rights to your sisters child as she is born in the U.S she is legal, her father is not, if you tell the police they can find him DEPORT HIM and give your sister a restraining order. Seriously, Your sister needs to understand she DOESN'T NEED This awful man in her life, I mean he is capable of taking your sisters child back to wherever he lives and your sister may never find her child again, Get this creep out of both of your lifes.

Whether you are legal or ilegal, law is the law. A parent have to be assigned guardianship of their child through family court before taking him/her anywhere out of the place where the child resides. Otherwise whoever removes the child of his/her place of residence will be charged wth kidnapping.

if the child was born in America, the child is a US citizen.. the reason the father may be trying to take the child away is to not pay child support... have your sister go to the county courthouse to get custody papers started... Good Luck
