My boyfriend was arrested 10/26/06 in NY (Chautauqua County) for an old (2000) warrant out of Middlesex County, New Jersey for a probation violation. They said he is a fugitive. He did not know he was still on probation or he would just have transferred his probation up to NY. Is there a time limit to when he will get an extradtion hearing. And once he gets the hearing does the 30 days start from the hearing or when he got arrested for NJ to come and get him. He takes medication for a mental condition and this whole process is not helping. Any help would be appreciated.

One of the standard terms and conditions of probation is that the probationer pays the cost of extradition back to the state where he/she was placed on probation. Your boyfriend will have to pay the entire costs of being returned to NJ.

Your boyfriend might as well not fight the extradition process since all he will be doing is delaying the inevitable. He will probably have to finish serving his sentence in jail.
