the police found one bag and put it on two people my boyfriend was one of them he has a year left on parole what happens to him now hes a good person and was just hanging out on the block something he dosent do often and they took him

Of course-all criminals are good people...you did not specify what was in the "bag". many things could be in a bag.

well, he will have a violation of parole but depending on the state, parole officer, circumstances, etc.....he may go back and finish out his time sentence or they may continue his parole. definately bond him out if he has a bond set quickly.....sometimes it takes a few days to get a parole hold put on someone while they are in jail. either way, get an atty fast! you both need to know all the options and what he is facing.
was the bag pot or something else? that can make a difference. also, the charges that he is on parole for can make a difference.



as far as that answer above about police being racist......let me tell you a story:
we had a 'street person' (homeless) girl on bond. one of our bond agents went to look for her in one of the neigoborhoods where she stays.....it just happened to be a neighborhood that is called "crackville" because it is a 4-block area where a whole lot of drug sales occur. this bond agent is a woman and has been a bond agent for almost 10 years. she always carries her bail bond ID with her. she is white, over 60 years old, and looks like someone's sweet little grandmother. (but she is tough as nails and has brought in more bond jumppers than anyone else in the company's 30 year history)
she got out of her car and approached 2 street people sitting near a house to ask them to let the girl know we needed to see her. as she approached, a cop pulled up and demanded to know why she was going to a known crackhouse. the 2 people started yelling "she's the bond lady! she's the bond lady!" she showed the cop her bond ID and explained why she was there. the cop left. (the cop was a rookie) does that sound like racism to you?
and that is the story of how Pat almost got picked up for possession.

If your boyfriend is on parole depending on the state he will be violated that means 30 days in prison of which he'll have to do 1/2 (15)days.he may get out sooner if 1) he was not in possession himself,2) if the other person acknowledges it was his.If it is found he was in possession he will probably get a new case, besides the parole violation. And it all depends what substance we are talking about...I would suggest your friend get
his friend to admit he had possession ,otherwise your friend is looking at a new case besides the parole violation....

He violated his parole.....either he was holding the bag or hangin' with someone who had it....if he is on parole you would think he would be smart enough to stay away from people that are holding drugs unless he is using again himself....some people never change....oh of course he is a good person....just a good person on parole...that hangs with the wrong crowd...will he ever learn? dump him and run far away

It all depends on whether he's convicted. You can get arrested, but in most states you won't violate your probation if you're not convicted of any crime. If he is convicted of CDS:Possession then he'll probably be violated and he may or may not go back to jail. It all depends on how well he's been doing on parole, and how the commissioner feels that day, and what his parole officer recommends.

He needs an attorney, most likley his parole officer will violate his parole and put a parole hold on him. If he is found guilty, most likley he will also have to serve the rest of his orginal sentence also.

I'm afraid he violated his parole and I'm sure he will get some kind of harsh sentence. It doesn't really matter that he wasn't doing anything, You can not put yourself in that position to be around things like that. I'm not an expert or anything but I do work in a jail.

The big question?? Where was this bag found? Is he on parole for dope? No one wants to fess up to this kinda thing. But if it was not on him, and it can not be pinned on him. Get an attorney.

Its usually up to his po. Based on his progress since on parole they could recommend him for prop36.

Sounds like a case of constructive possession. That means 2 or more people can possess the same item. Sounds like he needs new friends or you need a new boyfriend.
