Do I need to be a U.S. citizen for that? I am married to a U.S. citizen for over 5 yrs now. I am currently in Brazil taking care of my parents and my husband is in the U.S. working. How do I apply for my parents and my brother? My brother has cerebral palsy, he's 22, completely dependent on us, so he would have to go together with my parents. I've heard that parents have priority on the application. Is there a way my brother could also be accepted, since he's handicapped? He couldn't stay here by himself. And I'm the only closest family member who would be able to take care of the 3 of them.

Yes, if you are a legal resident you can file for your family. It would be quicker if you had your citizenship. File now and when you become a naturalized citizen it will be moved up. If you contact the US Congressman in your district they can help you with the follow up work and make sure your process is taken care of. As far as your brother being somewhat handicapped you need to get in touch with an immigration atty and see if there is a medical waver you might be able to apply for.
