Being so close to Christmas & having a family, this has affected my health & I cannot sleep and have mood swings. I can be very angry at times which leads me to having frequent arguments with my wife. To make things worse, I have two small children of school age, and obviously got the usual expenses such as mortgage, car and the other regular house bills.

I am also feeling very depressed and have lost confidence in myself. After much persuasion from my wife, I visited my GP last week who prescribed me with some tablets to cure my depression.

Lastly, the way I was selected for redundancy seems to be rather unfair.

Can you tell me if I can take any action against the employer for unfair dismissal & the fact that it has affected my health.

Why were you selected for redundancy - you don't elaborate on that. Perhaps you were selected because you may not have performed as good as you could, late, absent frequently, came up with lame excuses for not producing the work etc.

Perhaps look long and hard at your behaviour at work and you may come up with some of the reasons you may have been selected for redundant.

Unless the company is in dire straits, they will not get rid of their best people!

I am so sorry for what you have experienced. A good many people have experienced the same, and knowing you are in alot of company does not make it any better. Nor is the timing ideal.

I run a Career Network since 2001 that has supported people that started getting laid off in October -January.. It has been my experience that the best thing you can do for yourself and your family is to let your next best job be your revenge.. find something better than you had before. Many employers are "at will" which means they are not obligated for anything other than consistent and fair dismissal of redundant staff.

I am not an Employment Law Counselor, so if you feel there is more than you can share here, please consult an employment lawyer to evaluate the case.

If you feel the selection proscess for your redundancy was unfair, you could talk to a solicitor dealing with employment law. as you don't tell us what the circumstances were, we can olny guess.

It's unlikely that your former employer can be held responsible for your decline in menatl heatlh. Everyone who looses a job goes through it... even if you resign and walk away from a 13 year job as I did, with a newborn... the depression still strikes.

I'd day your better option is, instead of wasting energies fighting your old employer... get the out there and fight for a new, and better job.

Christmass is 2 months away, if you get work soon, you will get at least one pay day in before then. Local councills are usually looking for people to work in dull jobs.... try there, take the dull job and earn money (provide for those wonderfull kids of yours) while you look for the real job you want.

You did not give details of how you were made redudndant but I will advise that you talk to a trusted fellow about what really happened. If u still feel strong about your position then let nothing stop you from taking them on. Meanwhile try scouting for a new job now, go to all extent possible because people are depending on you so cannot afford to let them down.

without the full details of the redundancy its hard to know if you have a case for constructive dismissal. If a trade union member, contact your rep asap, if not, try Acas and citizens advice who can advise you on where you stand.

Im also assuming that you have contacted jobcentre plus to sort out a claim, whilst this might not cover all expenses it will ease the burden (i think you can claim a benefit to help with the mortgage)

its not the end of the world mate! other opportunities will come but its entirely up 2 u whether 2 chase yesterdays bird or 2moros.

if indeed its yesterdays, dont forget u will need money 2 give ur former employer a case 2 run with.

move on, ur family needs u.

Unless you can prove unfair dismissal, you will have to find another job

You need to tell us more about why they dismissed you what reasons did they give? What makes you feel it was un fair?
