Yes, however typically when this happens there are a few countries waiting around with military vessels in the area and make a md dash to peg their flag in the new ground first. So you'll have competition and no one to protect your new country from immediate take over.

No. Someone will already own it and have a name for it before it even breaks the surface.

I mean, look at Hawaii. There's a new island forming off the Big Island. Its name is Lo'ihi and it's the youngest Hawaiian volcano.

Its summit is still about 975 m below sea level so it has a ways to go yet. You might read all kinds of estimates about how long it will take to break the surface but the truth is that nobody knows. Guesses range from 1000 years to 50,000 years.

It is also possible that it may never make it at all. Recently geologists discovered another undersea volcano off the shores of the big island, but this one is off the NW coast (unlike Lo'ihi, which is off the SE coast). They named this underwater volcano "Mahukona", after the nearest town on the shoreline of the big island. It is pretty certain that this is an old Hawaiian volcano, but there is considerable debate as to whether it ever did make it to the surface to form an island.
