Yes, they can still charge you if an arrest was made, however if the arresting officer is not present you may face a postponement, talk to your legal representative. While the arresting officer may not be present the charges and paper work will still be there.

Usually public intoxication is only a misdemeanor--as long as the paper work is properly processed the arresting officer does not have to be in court!

Yes. The arresting officer will need to be called to give testimony in person but the charge is not dropped if he doesn't attend the first hearing.
