Yes, most gossip is protected except where recklessly or intentionally untrue AND harm results to someone else. At that point, it is called defamation (slander if spoken; libel if printed).

Gossip is meant to cause harm and emotional injury to a person and constitution should not be allowed to cover that

Free speech is free speech... But one must always remember. There are laws to protect us from slander/gossip.
