First you have to have a standing in the case. You have to personally be stoped from doing something or forced to do something that you don't agree with according to the constitution.
Then you file a federal law suit, it has to go though the federal law suit, the appeal court and then to the Supreme Court for them to decide

Law suit in Federal Court. If you lose, you appeal it until you manage to get to the Supreme Court. If you are lucky, they might hear your case. They are the ones that truly determine whether or not something is Constitutional.

Read the constitution. If it is not in the constitution, or goes against it, it is unconstitutional. Then take the evidence to the supreme court.
