It is a grass and if you don't believe me, call your county agricultural agent. it is a pernicious grass that will take over everthing if you don't watch out. It spreads by rizomes underground and if you want to control it, dig down around the area where you want to keep it in, and put in cap blocks on their edge, carefully going over it from time to time to get any new growth out of where it might even spread through that.
Frankly, I would get it out of my yard.

It's not really a tree, as you've noticed: if it's called a tree, that's only because it can grow very large. Giant timber bamboo can reach heights of 20 meters and diameters of 10 cm. That's huge for a grass -- big enough to look like a tree, certainly.

It's definately a grass! Some of them will grow a foot a day in the spring after a rain. No tree in the world can grow that fast.
