i was awake and remember them struggling to get the root. that was 3 years ago in another state. today the root has grown in. they never removed the whole thing. why did i even have it done? what did i pay for? can i sue?

Hey Susan. You probably had your wisdom tooth pulled because typically they are the hardest to keep clean therefore causing gum disease. Having it done was the reason you had to pay for it. You can try to sue but you will not win. Leaving the root tip behind was probably best for you. There could have been complication with bleeding if the "tip" was at an angle that dental instruments could not reach. The reason dentist does not worry about the tip is because 85% of the time the "tip" surfaces and fall out. You would probably mistaken it for a piece of bone :)

perhaps you paid for them to try and get it out, and they told you that you needed to go to a oral surgeon to have it taken out? a denist often can not get all of a root and will tell you to have it taken out completely when you can

You can only sue if you can find another dentist to testify that the other dentist did not do it right

Sure you can. In America, we have the "five anys". Anytime, anyplace, anyone, for anything. That is why people sue so much. Look for some "ambulance chaser", and get him to agree to a contingency fee. That's when he takes his fee from whatever he manages to collect. This usually is about one third of the total.
