You can only get extra legal games from iTunes for 5th generation (video) ipods. I don't know if there are any websites that are offering games, but it wouldn't be illegal unless they were stolen from the official makers.

ummmmm. he is probably running non-apple software on his ipod to be playing that, search for ipod software on google. To my knowledge installing the software is EXTREMELY HARD!
