Income Support and DLA are paid through different departments. As DLA is separate, any monies owed cannot be taken directly. However they can have you set up a direct debit to have the funds paid back that way. If you are working at all now, they are also able to set up a payment through your wages instead without your permission.

If you were aware of this mistake and did not inform them they can take whatever efforts they need to get the money back including court injunctions, etc, so it is in your best interest to repay however you can. Even if it is down to their own error, they can still reclaim what is owed.

Talk to them and see if you can come to some arrangement before things get out of hand.

Good Luck

as far as i know DLA is calculated an regulated by a separate body from the ones who pay out income support,
and therefore, any over payment of income support can only be deducted from income support payments or my the person owing the overpayment actually paying the money back in some other way, it cant be deducted from DLA

no the amount of allowance is set. if it was the DSS fault that overpayment was made and it was not likely that the claimant would have known it was over paid then it is tough on the DSS. as an example with a new claim or an adjustment to a claim. if is likely that the claimant knew that the payment was too high then the DSS can claim it back.

Each claim is separate so there for over payments cant be taken out of other benefits!

I don't really understand your question, but if you overpaid them trying to recover it will be an uphill climb; if they overpaid you though it's altogether different... well it's also an uphill kinda thing so maybe not so different.
