While my husband was in jail, he signed a Grant Deed and P.O.A. to me. Now that he got out, (he was in for abusing me) I would like to divorce him. Should I sell the house first and then start the divorce?

What you should do depends on the divorce law in the state in which you reside. And no matter what the law says, your first move is to contact a competent local matrimonial attorney.

Are the grant deed and P.O.A still in effect? If you can, sell the house first and find a place where you can live (and don't let him know where) and then start the divorce proceedings. You need to be away from him and, at least, salvage whatever you can for yourself. Good Luck!!

I think if all the paper work is legitimate than keep everything and find a good attorney. Probably a PPO is a good idea too. If he hurt you in the past and went to prison, chances are he isn't done with you yet. I am not in any way trying to scare you, I have had to put my fiance in prison on more than one occasion for the same, maybe worse, type of "abuse". As we speak he is looking at even more time this time, every time they let him go he tries to hurt me worse than the last time, because his anger grows every time he gets back to prison. I know a PPO is just a piece of paper that isn't bullet, fist, knife or fire proof, but it can help, to a degree anyway! Best wishes, and STAY SAFE!! Please don't do like I have in the past and allow yourself to get sucked back into his "games"...You are better and you deserve to feel safe and loved with someone who won't hurt you! Best wishes...

That all depends on the laws of the state you are in. You should have done all this BEFORE his release. Now, you just may have to give him half of the of money from the sale of the property. Consult an attorney that specializes in divorce. Good luck. I hope you have a restraining order in place . If not, get one ASAP.

YOu don't look like a woman. You should have divorced him when he was in jail. Now he can claim half the proceeds which he may well deserve.
