i have an exam to study for and this is the main question. how does power check power in America's constitutional government?

There are numerous checks and balances within the government. I'll give you a partial list..

Executive check on Legislative: President can veto acts of congress

Leg. check on Exec.: Congress can override veto with 2/3 vote of both houses. Also, the Senate must approve appointments that the President makes to federal offices and to the courts.

Jud. check on Leg. and Exec.: Supreme court can overturn acts of Congress and Executive Orders (this is called Judicial review, which the Court established for itself)

Exec. check on Judicial: President appoints judges to federal courts.

The list goes on, but those are the important ones.

The way power checks power is through the division of the government into three separate branches the executive, legislative and the judicial. Congress can hold hearings and investigate wrong doing by the executive. The executive can appoint special prosecutors and has the office of Attorney General to investigate wrong doing. The executive appoints court justices and federal judges, the Senate confirms those appointments. The federal courts and the Supreme Court can hear cases and rule on legislation and executive orders and practices. This is the system of checks and balances built into the US Constitution.

No one of the three has more power than the other two. Laws made by congress have to be to be constitutional by the Supreme Court, and laws are subject to veto by the President.
