Long story short.SSI case filed in 2002,been fighting with them all this time.Last May Judge finds that person is disabled.Ok person has lived with someone since 1996,get married in 2003 while fighting for SSI.Now SSI says income too high for benifits...ok fine....Now back pay up to time they get married they say no pay....based on the income (other persons)even though they were not married and that person did not work and had no income.This dont sound right to me.How can they do that???

Found out they have added crap to there rules....But still can only keep 1/3
the"In-Kind Support and Maintenance"
what a bunch of bull! Like how are you suppose to live if you cant work?? I better hush before I say something insulting...

You should definitely consult with a lawyer. I highly recommend running your situation by a group of people who have personal experience appealing SSA decisions. They may also be able to recommend an attorney. Check with them at the Yahoo! Group:

They can (and do) base your SS benefits rate on your household income (you and spouse). That should hold from 2003 +.

However, the benefit rate (and back pay) from the time of the claim up to the marriage date should be based on the filer's income alone. If the SS Office has not done this, they are wrong.

Definitely get a lawyer. It doesn't sound right to me either. If you are disabled, you are due the SSI. A lawyer can help you on a contingency basis. But, be prepared for another long wait.

Wow you do no longer think of that's appropriate for the daddy of your infants to help them together with his SSI money... despite the fact that it perfect for the tax payer who had no longer something to do with you getting pregnant to help you with welfare.. he's earning money is needs to pay for the youngsters he created.... even that's with SSI money!

if a person is disabled they are intitled to benifits. the amount may be reduced. but they can not keep the back pay...

if i were you get a divorce, so you or your husband which ever one filed for SSI, can get their full benefits.
