Is it legal for Alliance One(in San Diego,Ca.)to call me relentlessly with threats of having arrest warrants issued, unless receipt of entire balance is forthcoming? Are they in a position to initiate legal action?

This is not the middle ages. We do NOT have debtor prisons. There are people that have gone to jail for fraud and bad checks, but that is a deliberate and malicious act. When the creditor calls again tell them that you do NOT want them to contact you by phone any longer and that mail contact is all you'll review. They MUST follow this under the Fair Credit Act. They CAN sue you in court, but unless the amount is very large 1000+ that is also unlikely. Them threatening you with this garbage is just a sad tactic of unscrupulous companies.

If you are concerned about jail time consult a lawyer to ensure that it's not something they can do. At worst they will win a judgment in court that will show up on your credit report until paid off. Good Luck!

If I am correct, they are a collection agency for the San Diego court system. If you have an unpaid fine, they could send it back to the court and have them issue a warrant. I'd try to make some sort of arrangements with them, otherwise it could cost you more money in the end.

The most they can do is take you to court to get a judgment against you. In civil court, not criminal court. You won't be arrested, just served papers notifying you of the lawsuit. Then they could garnish your wages or put liens on any property you own. They are trying to scare you into paying them. I don't think they can harass you at work, but they can call you at home. I'm not sure how many times a day would be considered harassment. If it's beyond you talking to them to see about a settlement, maybe try contacting a non profit credit counseling service to have them work out a payment plan, just research them through the better business bureau first to make sure they are a legit company, or call a bankruptcy attorney to see what kind of relief they can give you.

Absofreekinlutely NOT! 1st. write them up on (ripoff report.com), someone may contact you as to how to rip them a new butt, then turn them in for making threats. There is no debtors prison and they can not harrass you or threaten you to get you to pay up. Don't warn them, just record the threats, then turn the tables. The only thing they can do to you is... bug you by mail and trash your credit rating. If they are buggin you it's because they have already got a judgement against you or they have bought the debt from a lender and are pursuing the payoff. Now...If it's the I.R.S. work with them...THEY can put you away.

Under no circumstances can they have this power. It is not illegal to have an unpaid debt. You can also check on the laws in your state concerning harassment from bill collectors. I think you'll find that the calls can be stopped or at least minimized. They are just pressing you to see what you will do. In truth all they can do is sue you for the unpaid balance and associated collection costs.

They can sue you, but they can't arrest you. I recently was falsely accused of being involved in a car accident; the collections agencyand that the insurance company was using came after me told me I had to pay or I would have my drivers license revoked. Collections agencies like to use scare tactics, you have to bark back!

They are in a position to initiate CIVIL legal action, but not criminal. They can not have you arrested, and you can not go to jail, but they can have a subpoena issued to you forcing you to court for a civil case, (they can sue you). Your best bet is that if you owe them money and are in financial trouble, call them and get yourself put on some sort of payment schedule that you can afford. Or contact a service that will work with all of your creditors and help you figure out a way to get out of debt.

thats there job to annoy you and scare you... a collection agency calls me and there so annoying i argued with them .... but no i dont think they could do that they would of done it already... at least thats what i think.. well if you got a laywer ask him/her ....
