Our payweek ends on Sun. Checks are available for pick up on Wed. but direct deposit s are not available untill Thurs. morning. Is that legal? I am in New York State.

What is the day the checks are valid for. I will bet they are dated for Thursday. If they are not then you have a beef, all payroll must be consistently available to all employees. Everyone gets paid the same day each week. Most companies deposit money for DD ahead of passing out checks by the overnight (DD is available first thing in the morning.

I don't see why they aren't available at the same time. Someone in payroll is dropping the ball. Direct deposits may need to be processed on Tues. to ba available by Wed. If they are processed on Wed. then that's why they aren't available till Thurs.

I'm also in NY state. To the best of my knowledge, an employer can't discriminate against employees by allowing employees with paper checks to get paid 1 day earlier than those with direct deposit.

Check with the Labor department.

Your employer probably has sent the funds to the bank electronically for direct deposit, but when the bank chooses to make those funds available is up to them.
