For my 2005 taxes I filed Head of Household with HR block. I'm married, but my husband isn't a U.S. resident and doesn't have a soc. sec. #. So the HRBlock rep told me to file under Head of Household to avoid having to put his info. I'm looking and the IRS website now and their definition of Head of Household is "Head of Household Generally, you may claim head of household filing status on your tax return only if you are unmarried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or other qualifying individuals. " I ended up owing about $3000 in the end. Would I have still owed that much if I had filed married joint/separate? If so isn't HR Block responsible for the error?

Yes they are. You need to take this matter up in person with them. Dont try to do it over the phone cause it will just get all confusing and then tempers will flare.

They have a policy that if the taxes are filied wrong them are responsible ore something like that. In the packet that they gave you there should be a list of terms or somethign along those lines.

I have SAME ISSUE and you should not be owing anything, and By it being a mistake H&R BLOCK may owe you, You may need to get a personal tax consultant this year or next, My consultant would always advise me to file head of household when I was married because my spouse got in some deep do do with the IRS and wanted me to bail him out this would have been not so good for me because he owed the IRS and had I files w/him they would have taken ALL of our son's SSI, ect... So even now being that I have remarried my new husband owes a LARGE Student Loan he never did a deferment before we got married so I would still need to FILE Head of Household so that the IRS want take my Taxes and my son's SSI. So if I were you just contact H&R BLOCK they may or may not own up to their mistake if not DON'T USE/PAY THEM ANYMORE. Take Care
