....Gets pregnant with the guy, now husband wants a divorce, wife claims she will never give him a divorce, that she will always be his wife 'til death do they part.He doesnt love her anymore but she insists that they will always be together.What do u think of this woman?And can he divorce her without her signature? Cause she says she will never sign papers....Your opinion please.

to 'warequals':there's no chance for them.this isnt the first time she cheated.She has cheated with his friends, except now she got pregnant by this one.

Yes he can divorce her!!!! The court will order it, it will take longer if she won't agree on anything, but it will happen regardless of how she feels about it! Especially considering she is pregnant with another mans baby!!!!! The courts usually won't allow a divorce while the woman is pregnant though. He will have to wait until the birth, prove the baby isn't his, and then he will be given the divorce. In the meantime, he can move out of the house.

Pregnant or not with someone else would be both costly and hard to prove. Even with a witness.
You file for irreconcilable differences and let her fight it. That covers a hole area and she can't prove or disprove anything. It's the 12 year old that's going to suffer. Right now you both have what I'd call a no turning back. I can't see where you'd be able to "start over" even with counseling. It would be better to move on but again, what about the 12 year old?

It sounds like she needs help. You didn't ask about it but, that's what I'd say, she needs counseling real bad. As for you, get out.

You do not need both parties signatures for a divorce. The courts will grant him one it will just take longer than normal. You have no choice in the matter if the man tells them there are irreconcilable differences!! He needs to consult an attorney, and move on with his life!!

Of course, he can divorce her. He will now have to take her to court. This sounds like it will be a messy divorce, but he has the right. In the end, the court will decide the dividing of assets, child support, etc, and will grant the divorce.

This is truly an unfortunate situation, however the husband and wife have to be allowed to react and make choices as individuals.

I have experienced my wife cheating on me, early in our marriage...we survived and have grown closer than most couples I know...we will celebrate 16 years of marriage this year.

Long story short, we went through recovery and learned some dark history in our individual lives. I suspect that in your case, both the husband and wife have some issues that they need to address before moving on, individually or married.

I hope that they both seek some wisdom for themselves before making any more choices that they could regret later in life.

if he stays with her even thou the child is not his, for a period of time the court will say he accepted responsibility for the child and he will have to pay support. if she has cheated in the past she is going to do it again. tell him to leave, go for a legal separation due to her adultery, then after a year in most places the divorce can be granted without her permission

well she, cheated not him ,and yes he can divorce her,she broke there vows.this part about until death do her part what do she mean she cheated on the man, her part is done and its not until death do them part unless she have another idea which is scary.she hurt her husband, as well as her family just to have sex. its not worth it.he will get that divorce trust me she don,t have a leg to stand on.there is a clause she better well be aware of all he needs to do is stay away from her, he will get what he want and the house.and she is pregant by this man oh hell yes he going to get it all she can forget it.

Well sounds to me that she needs some big time help.........and yes you can get a divorce without her signature. You can't be force to stay in a bad marriage by anyone.

She doesn't have a choice in the matter, she is pregnant for another man and therefore proves she commited ''ADULTRY'' and that is all the guy needs for a divorce, with or with out her signature.

You can't exactly claim the til death do you part vow when you did not keep the other part of the vow! You made your bed, so now have to lay in it! Let the man go - you got yourself into this.
