We recently built a house. The well digger hit water at 22 feet and continued until the well was 34 feet. He assured us that we would not have any water problems. Well, last week our well was so low, the pump was unable to pump water. We have had alot of rain lately so this really scares me. I was told that it is not so uncommon for a well to be bad during the first year. We did not have a written contract. I have contacted my States Attorney, he says I do not have a case to take legal action. Any suggestions out there as to what I should do. We hauled water the other day, and this is not something i want to get used to.

I guess you learned your lesson by not having a contract. There is nothing legal you can do about it. The only thing you can do is get another well drilling company to come out and either drill deeper or drill a new one. Sorry this has happened to you.
Make sure the next person has a license and you get a contract!

1) You shoul dhave had a written contract. Contracts protect you the purchaser and the driller in case something goes wrong. They are more expensive, but it does give you some recourse if the other party is not as trustworthy.
2) Have you talked to the driller? Maybe you can come to an agreement with him to come back for a reduced price.
3) Drilling a well is a crapshoot. We can have all the geologic knowledge possible, but we rarely know what will come out of the ground. The recharge rate is often unknown. If the driller was reputable and competent, then he should have done a pump test to verify the reliability of this well. But, it seems you were trying to do this on the cheap, and you are paying for this decision now.
4) If there is a local water system, maybe it would be cheaper and easier to be connected to their water.

you will need to dig a deeper well or a new one and pay all those fees and things again you can try and get the guy who dug the last one to do it for free since he lied but nothing you can do from a legal stand point but you might be able to get your money back in small claims court my well is 624' and i know i wont have any problems i have more water than i need just had it done 3 months ago cost me 6 grand with everything but i made sure i had a contract
