i have been working at this place for 2 weeks (i realy like it) screwed up my back and got put on work restriction. then i got fired for "lack of preformance" is this legal? is their a website for work restriction laws in wisconsin?

Not legal....if the injury was work related and you filed all the paper work....if you got hurt outside of work I am not sure how that works....make sure you have all the documents and doctors notes and such and then talk to a lawyer....most will give you a free consultation....

Check with a workers comp attorney. I don't know how the laws are in Wisconsin, but here in California the fact that you were only working two weeks probably means you don't have much of a claim just becuase of the time, but that's not right that they fired you for that reason. Also, if you get another employment after this one, no job can legally refuse you work becuase of a workers compensation claim or becuase of disability.

You need to find out if Wisconsin is an "at will" state. Also, does the company have a 90 day probationary period? If they have the "at will" and / or probationary period then yes, they can fire you for anything at anytime. You cannot draw unemployment since you have not been working there long enough.

Depends on the official reason...If you are incapable of performing the work given to you,it is legal to fire you...all they are liable for is doctors bills if it was a work related injury.
If your injury was caused because you are not fit enough to do the job,they are not obligated to employ you.

sounds like they were trying to avoid a lawsuit. was it manual labor? did you injur yourself on their site, doing something required by the job?

i worked for a place like this in ny. they let a guy go after 4 days and a ride in an ambulance.

definately contact your local authorities and investigate this until you are set straight!!! and feel better soon!

You would have to look up the labor laws of your state. That information is online somewhere.

No im pretty sure thats illegal - I ould contact your civic advice centre and take it up with them. Bastards.
