It was actually the First Continental Congress, in their final act of dissolution before our current government was set up.

the Constitution needed 2/3s of the states to ratify it before it could go into effect, this happened as soon as word that New Hampshire had ratified it was received. VA ratifed it within a week of NH and NY, a month. In that day and age, word traveled slowly. By the time news of NH's ratification reached Congress, the other two had ratified it as well. Not to mention governments don't start instantaneously and time was needed to set up the new government.
