We had a session with a prof. photographer for sons,ages 1 and 2. Stressing we needed the earliest time to work around naps, the photographer was 20min late.After poses the kids no longer wanted to sit.We said it was best to move to candids.There were toys and they were having a great time playing.She kept forcing more posed ones -then tried to bribe them with a TREAT for after. To 1 and 2 year olds, treat means treat NOW. We said no, this created a meltdown. All I had was movie candy, and it stained the mouths.The photographer,said no problem,she can fix that after and soon ended the session 30min EARLY!Saying she had what she needed. After seeing the proofs, they werent just bad, but didnt meet the minimum number stated and arrived later than stated.We civilly asked about this,she went off calling us bad parents for the candy .She wont return calls/emails.We're out $70 for the sitting.Kids can be hard to photograph,but her actions made this more difficult. Think we have small claim?

if you have everything she stated she would do in writng then yes it is just the case that small claims deals with...if you win she will have to pay your filing fees.
First write a letter to her stating your desires send it certified. if she doesn't respond with aresoluton is 30 days go ahead and file. It is a simple process and the file clerk will help you.

i don't know where you live but in Texas it costs 60 dollars to go to small claims court sounds like shoddy work and the judge would prob rule in your favor in which case the photographer would be responsible to pay your court cost however the judge would probably only give half your money back since the photographer would need to be reimbursed something for her time so i guess that only leaves her about negative 25 dollars still worth it on principle though i would do it.

Send a letter demanding a refund first. Keep a copy for yourself (this shows you made an attempt to avoid court.)
Next get another Photog to do the pics. You will need to show the court how much it cost you. If it is more for the new Photog you can recover that extra as well.

When she refuses, take her to small claims. You will need your proof of purchase (receipt and canceled check), the extra cost will help, and she will have to pay court costs as well.

You NEVER pay before seeing the results. You can take it to small claims, but think of the time wasted. I would just pass the word around that she is a screw up. Put her out of business.

possibly. Do you have all your paperwork and the pictures and/or proofs? If so I would consult a laywer to see what your options are.
Good luck. I would be in the same mind frame if that happened to me!

are you seirous , people like you are ruining the court system and bogging it down with silly crap, no you have no claim , she can come to court and say the kids were ill mannered and then it is a matter of who believes who , she will win because she is the ''professional photorapher, and you will seem like overzealous parents that are unhappy with your kids first pictures ........just chalk it up to experience and go someplace else ........
