I own a condo, which I'm renting out. The tenant was supposed to pay a one month security deposit. He only paid a portion of it when he signed the lease and said he would pay the balance in two weeks. After numerous calls and promises, I'm assuming he just doesn't have the money. I am not as concerned with getting the security deposit, as I am that he may try to get back a full month's rent when he moves out. What steps should I take to protect myself?

i hope you gave him a receipt for what he actually paid you... oh, and evict him.

Have him sign a contract that he has not fully paid his security deposit. Subject to change, whenever he does decide to fully pay the security deposit.
Have a clause at the bottom that he can sign when/if he ever pays fully.
The security deposit will only be reimbursed to him when he leaves the condo and the remainder to of the balance is paid in full.

Well, first off don't let him move in the next time until you have everything. If he isn't paying now, he probably will give you a problem about the rent down the line. The thing here isn't what he tries to do when he moves out because you have records. It is rather he is going to work out as a tenant at all.

I would seriously escalate things and threaten to evict now. This is just a bad sign and he sounds like problems to me. If you let it go and he misses rent then what?

Did you give them a receipt for paying the partial security deposit? If so then you should have had a balance due on there.
Dated? This should cover you. He knows he did not pay the full amount. I don't think he would be foolish enough to try to get the full amount.
I would never accept a partial amount in the future unless I put it on the lease agreement. The amount that is supposed to be paid and the date etc..

i dont think you need to worry about the security deposit. if the tenant already moved in you better start worrying about collecting rent ... it is a safe bet you are not going to get it. so really friendly advice, start eviction proceedings right away no matter what the excuse is, chances are this guy has already done this before and will drag it out as long as possible all the while living in your apartment rent free!

if they havent moved in yet, give him back the money and DONT LET THEM MOVE IN!!!!

Assuming you have your agreement in writing (including that he will pay a security deposit of $X) then threaten to evict him if he does not comply with the terms of your agreement.

Get it all in writing and have it notarized, say its for both of your protections. Keep all reciepts. Do a credit check on the guy, he could walk off with the sink, stove and refridgerator. In one case I know of the deadbeat walked off with the bathroom sink and toilet too. Also take time dated pics of the house before you let him in and when he leaves. If hes already in, and it sounds that way then ask to take the pics now.

Put in writing what he has given you so far and have him sign then evict him
