My friend just found out that her ex and his new girlfriend have started a myspace account pretending to be her with a hotmail account they locked her out of. They have very rude and untrue things on the page and have been sending rude messages to people as her. Is there anything legally she can do to get them in trouble for this?

Under occupation they put "UMEMPLOYED(who needs a job when theres welfare?)" which is funny b/c they cant even pay their electric bill and she works fulltime and goes to school fulltime and in June will graduate as a surgical tech.

She can contact Myspace about it. She might have to send them a picture of her holding a sign saying...the real so and so on it and the date

they should delete it for her but that won't stop them...she could just contact her real friends and let them know that she's not doing that if they are dumb enough to fall for it in the first place. or start her own myspace page

Report the account to myspace as being fraduelnt or inpersonating. Yes there is legal action allowed if you can prove who created the defamation of character page.

contact myspace and the police to file a report. if she has all the reports and prints what was on the site while its up- she can file in small claims court. I am guessing that the loser couple who did it don't have much if they spend time doing this stuff.

Yes. Have her contact a lawyer. For one, it is impersonation, for two it is libel (slander is spoken). Good luck to your friend. Tell her not to wait on this, do something about it before it gets too far out of hand.

she can file civil action against them, but if they don't own anything , she can 't get anything.

Report them to the myspace people,a nd next to the ISP of thier server.

Nope. They may have a case for slander. But you would need a lawyer to know for sure.

If she can prove it, it is libel. Yes she has recourse. She should show what damages it has caused her. Her reputation, friendship etc...
