I came back to England nearly 4 years ago, having lived in poverty for 10 years. Unbeknown to me my spanish husband is a bit retarded and I know that he won't answer any court papers. I know that I can wait 5 years for an uncontested divorce but he will still be sent divorce papers that will need to be returned. I want nothing from him regarding property, goods, maintenance just my freedom. Any one know the law and how I will be able to get the divorce? I can't prove my ex's mental state but I know that he will just ignore the letters. Surely he wouldn't be served them personally! Please Help!

Thanks all. My ex hasn't got a solicitor and never leaves the village. He speaks to no one. He doesn't speak english. I took our 17 yr old son to see him in 2006 and 2005, he was incommunicative and I was unable to talk about divorce, had enough trouble retrieving books etc of mine. I suppose I will just have to wait the 5 years of separation and see what happens.

I SUGGEST TALKING TO A ASOLCIICTOR OR BARRISTER -EXPENSIVEEEEEEEEEE, who deals in international cases, or going to spain and speaking to a solcitor over there, id try here first - at leat they can give you a lsit of solicitors theyve dealt with in spain in the past.

I have exactly the same question! My husband went back to India and is not responding to any papers I send him...

I have no idea what to do either and everything I think of costs a lot of money! I don't know what to do either...

I'll be watching of other people's answers as I need to know this too. Any legal people out there?

(I can tell, we're going to get some real dimwitted answers here.)

u will have to use the law under separation and desertion,. since their is no contact claim you don't know how to find him or locate him, a notice w ill have to be fi led in a newspaper where you last knew he lived, for two to four weeks then divorce will be granted

get a good lawyer and claim that ur husband is not responding to the letters intensionally send him certified mail he has to accept it and ask for a return slip with that mail so if he accepts it then u got ur point that he is ignoring court orders if he ignors it u still got ur point that knowingly what it is he refused it so that makes ur case strong and u will get divorce in court

see a solicitor here in UK then have them transfer all papers over to his solicitor in spain, so they can issue them to him by hand, that way they will know he's had the papers and has to take them on board....i dont know the legal system in spain but i think that if they were served to him by a spanish solicitor then he'd have to respond to them...good luck

sorry to be blunt but wouldnt you know the spanish law having lived there for 10 years
i'd just look at spanish laws on the internet and find out that way

You should just wait until he comes back iof he is coming back
if hes not just tell him that u have enjoyed all the time with him but u think u should see other people

But do it very politely

Phone or if you really wanted to divorce him, then visit spain
