my ex has not had any contact with my daughter for the past 6 years. We were never married. I am married now and we gave my ex a chance to be a part of her life but he did not want it. Now my husband wants to adopt her and he has raised her since she was 1 and now she is 7 so he is the only dad she knows. what do i have to do if my ex wants to give up his rights voluntarily?

The first thing to do is contact an attorney who specializes in that field and ask that question. However, do you really want to give this guy a chance to weasel out of his rights scott free??? He helped produce your daughter, he should be helping support her, financially if nothing else whether he likes it or not. Someday your daughter might want to know her real dad, no matter how much of a loser he is. Perhaps you can have your daughter's last name changed to your husband's last name, but still have the ex paying support - just an idea!!!! Either way it is up to you, but the first thing to do is contact an attorney, or even a few attorney's, and do some research on your own in the meantime. Sure the guy wants to give up his rights, he is an immature dud of a boy (can't call a guy like that a man), but he is still this child's father and someday that might mean something to her. What is in this child's best interest - that is the question you need to ask yourself before taking this giant leap!!!!

Contact an attorney and start the adoption proceedings. They will inturn contact the biological father who will sign away his rights, although he can not be forced to. My daughter is 13 and wouldnt know her father {even though we were married} if he was the only person in the room with her {by his choice}. My husband is her "daddy" and he wants to adopt her but my exhusband will not give up his rights, no idea why since he's not seen her since she was a year old. And as a result my husband can not adopt her because you can not force a parent to give up his or her parental rights in cases such as this. Honestly a peice of paper wouldnt make a differance other then her last name because my husband is and always will be "dad" in her eyes and his

well if ur husband want to take the place where ur ex doesn't i would let him and if he is the only one she knows then why change it u don't know what would happen if u did

contact a lawyer to have papers drawn up then you all have to sign it. oh and it costs a fair bit.
