Hi,
I'm in the process of moving out of my parents home into an apartment. My question is i'm currently on informal probation, and i've plead guilty to commercial burglary with a misdermenor. Do you think I will have a problem getting an apartment? On my application i'm going to tell the 100% truth about what i've done.

Also, it's been over a year since my arrest, and i've completed all cal trans/community service, and took care of everything.

informal probation is probation where I don't have a probation officer, I don't get drug tests, no one comes and checks on me, but If I get arrested again i'm screwed!

Thanks everyone. This pretty much makes me feel better. I'm going to call my lawyer and see what he says also, and from there i'll just fill the application out and see what happens.

They usually only run a credit check, but if you're honest on the application I think that counts for a lot with everyone. You only need to tell them you have one misdemeanor conviction. That isn't enough to make you a career criminal to most people.

I've never heard of "informal" probation, you're either on or you're not, what exactly does that mean? (And I've worked in the criminal defense field for years!) If that's some judge saying "I don't want to see you in here again" then you're good to go on with the rest of your life. Congrats on getting it together and your move, good luck.

Fortunately the law is allowing us to have a criminal backround check before renting . Not because of you and your situation but because of all other situations before you. as you do know most of the terror-mongers were renting and remained under the radar due to no back round check.. I say just speak the truth, Prove your words, and be a model renter and you will never have a problem for renting now, and for the future if you ever want to move again...

I run credit on all of our prospective tenants. I work in property management. What I look for in a prospective tenant is whether or not they have had an eviction, that is really the only thing that we can legally base denial on. Our credit apps do not ask about a criminal history. If they ask you be honest, there is a chance they spend the money to do a criminal check, otherwise....don't ask .....don't tell should be your mantra. Don't give the rental office a reason to discriminate.

Different apartment complexes have different rules. My apartment doesn't allow anyone with any criminal history in the last 10 yrs. There are some places that don't do any background checks. You might look into something like that. Places that are listed by individuals rather than property management companies are less likely to check, they base more on your rental history or references.

Sounds like your parents did something right. You told the truth. If you lie on your application - they WILL find out - and out you'll go. It might even violate your probation.
It's best to tell the truth. If they won't take you - you don't want to live there.

I don't think you will have a problem, What they are usually looking for is if you have been in the prison system if you would have had a felony I would say no. The other thing is they will only do a check in your state if you were in trouble in another state they would not find it if they on did the check for the state. I know because my husband was in prison and we rented a apt. in the state we are living and they did a back ground check for this state only. they found nothing.

It will depend on the apartment complex and what their standards are. It varies on individual complexes. Most newer/nicer ones will probably deny you because they're trying to keep the community safe. Good luck!

Not sure...read Renting Rules...oh, now I am not sure of the name but it is for renters rights so they know what they can expect when renting.
