Well if the child is in his custody, he more then likely will not go to jail because they feel he is no longer neglecting his fatherly duties. The problem with this is, he does need to get right with the Child Support Case Worker and his support order for payments, so that the court will see him doing the right thing and award him custody, otherwise he will seem just as unfit as the mother and more then likely have to pay the support to a legal guardian of the child. So the first step here would be to contact the case worker in charge of his case and inform them on what his intentions are for his child. Good Luck!

He just found out he has a child? Now he owes back support? Now he wants custody? Well, I think if he pays some money towards the child support and promises to keep paying, he can keep out of jail. As for custody....well, if the mother lost custody and he can show he has a stable home, that's possible. What you need is a good lawyer, though. If you don't have money for a private lawyer, try Legal Aid or go to Family Court and ask to see a counselor.

uh....why would any judge in his right mind grant a man with felonies with full custody? and no parent will ever lose rights of their child unless they give them up voluntarily. if the mother is an unfit parent and the father is on his way to jail...child services will step in and take custody of the child.

back child support huh? sounds like a great boyfriend. what is HE doing to find out about his situation? are you doing more work then him?

Get a lawyer to protect his rights and those of the child.
