prosecute a mother for lying about her income to child support ( she said she made less than minimum wage) but then bought a 2004 car, and got a new apartment ( she told them her income was 3000 a month). She is a big time casino junkie.. hustler but always broke. She masterminded a payment of 1,044 a month for 1 child, and the judge ordered it to reflect to the date of birth. she claimed a 400a month child care expense and some more bs and they gave it to her, well now the father has custody, but he still owes 14,000 of back support. we have filed a motion to modify and we go to court nov.6 requesting all arreages be dropped because she provided false information to obtain more money. Do you think the District attorney will prosecute her? Shouldn't she be punished, put in jail.I want her to go to jail. she left this baby that we have now with numerous people, didnt give them any money,seems like she was tryin to use the baby 4 getin more $.we took him while she was filin 4 diabilit

get a family practice lawyer...it's worth the money..get the child back and then she will have to pay you.

Sure there are plenty of laws dealing with perjury issues, she falsified legal documents, this kind of situation has varying results. They may say that she is in contempt of the court, and place charges against her and give her some jail time or...they could make her pay the custodial parent which is now the father child support, and drop the arrears amount completely. All of this is contingent on whether you have real documentations proving these accusations.
Each judge is different in each court.

I really hate to say this but they will probably not prosecute her as judges do not like to prosecute single mothers. but you had better have proof of what you are saying or they will ignore it cause my cousin went to court to prosecute his ex-wife and they never did a thing to her cause she proved that her dad paid for her car and they said something about her having every right to ask for more money with the lifestyle she had become accustomed to do you believe that crap? Talk to a lawyer too they will let you know if you have a leg to stand on. Good luck and god bless.

If your claim is true, they will not overlook it and she will most likely be prosecuted.
You have to make sure all of your information is in tact and true because false accusations could get you in trouble.
If so, legally, she'll be punished and custody may be dropped from her to you.
However, if she's a mastermind, she may have ways to win the court over. Hire a good attorney.

Child support is not based on a woman's income. So there was no need for the woman to lie. Child support is based on the paying parents income. 17% each state is different. Search your states laws on the internet.

hopefully she goes to jail but before that see if the courts can garnish her wages as well as take her income tax return, prob. wont be 14,000 but could help out a little bit

If you can prove this it is fraud. You need to see a lawyer. First to see about getting custody, and second to see about having her prosecuted.
