My fiance and I are getting married on November and I don't work so how should he file this year? Is it joint or does he claim me as a dependant and my kids? Can he claim my kids?

It is your marital status at midnight on the 31st of December that is your status for the entire year. Yours would be married filing jointly and yes, he can claim the kids as they are part of the package. Only if you have released the dependancy for the children to another with a form 8332 would he not be able to claim said children.

You will be claiming married filing jointly and yes you will claim your kids, unless it says different in your divorce decree and the kids father has that right. One thing you do not want to do is claim married filing single. Your new husband will pay for it big time.

He can claim if you live in the same house and he supports you and your kids but you must let the benefit agency know if you are living together cos your money entitlement will change.
He can claim for your kids if he is living in the same residence & the kids biological father isn't claiming for them.
He may need to give in details of your income as well as his so make sure all relevent agencies know the situation or you could be done for fraud

It is joint, which means he can claim you.

But as far as your kids go, it depends on your divorce agreement with your husband. If you have sole possesion of your kids, then yes, he can claim them, if you have joint possesion, it depends. (usually the parents switch years in which they claim the kids).
