I live in NC. I was rear ended on an interstate off ramp by a tractor trailer. I had been forced to come to a complete stop because the 5-6 cars ahead of me had stopped. The tractor trailer was going about 7-9mph at the time. I was driving a Ford Explorer. There were only scratches on my bumper from the accident. The guy's insurance company just called to let me know they would pay for me & my 2 children's (5 and 10 year olds) medical bills and give me $150 for the scratches on my car. The medical bills came from going to the doctor to see why we had headaches the following day. Plus my neck hurt so bad I could not turn it without pain and my right eyelid was drooping for some reason. I missed a week out of work due to pain & drowsiness from the muscle relaxants my doc prescribed. Accident was 1-1/2 weeks ago ,Oct.13 2006. I didn't do a police report cause an officer directing traffic in the area said damage to my car was too minor to file. Is $150 + medical bills a fair settlement?

Get a personal injury lawyer. I hate dealing with lawyers but this time the other guy's insurance company is getting over on you. They should at least pay you for missed work as well as pain and suffering, in addition to medical bills and repairs. That may seem frivolous to others, but you know what? You didnt ask to get injured. and since they cant make you feel better, they darn well should compensate you for it!

Have you been to a doctor. Neck pain and drooping eye lid sounds serious.
Some PI lawyers offer free consultations. You should seek one.
I wouldn't say sue the truck driver, but you should make sure that you don't have the risk of future medical bills for this.
The offer by the insurance company IS fair if you were not seriously injured and if $150 will fully pay for the repairs to your bumper (plus expenses if you have to rent a car etc.)

no way but if you accepted you kind of did the wrong thing. thing with back pain is that those who truly do suffer from it usually start to feel it well after the accident. never accept things from the insurance company of the offender. you need a lawyer and they will do what you need to do for free until you settle they get a chunk but you will get more. keep all your documents and tell the truth and youll get whats coming to you. good luck

NO it's not. Yes accidents happen, that's why there's insurance. If you missed a week of work I would ask for that to be compensated as well. Are you still suffering how are the kids? If you need be seek legal aid, do it. Insurance, we all pay into it but they will try to pay out as little as they can.

no,It is not fair.If you have missed a weeks work.I hope you did not sign their check if they sent it already because that usally relieves them of their liabilies.you should have called another police officer if this one didn't have the time.Whiplash sometimes takes several days to show up.I would seek an attorney and get what was due me.They shoud add another 4 0's to that $150.00.Good Luck.

no,it is not. you missed work,i have a feeling your kids missed school,i think you lost money,too.$150 needs to be $150,000.
i feel very sorry for you ,too.case closed,settlement NOT fair.
