Absolutely. A child born in the United States is a citizen from birth. The citizenship of either parent is not at issue in that. However, some other countries do permit dual citizenship, so the child may also be considered a citizen of the parents' nationality, by that nation. The US does not recognize dual citizenship, so to the US, the child is purely a US citizen.

They are treated so. The Supreme Court withheld ruling on that point if the parents are illegal, but the states treat them as a citizen. If the parents are legally here, I think it is pretty clearly yes. I understand there are tours from Korea that bring pregnant women here to have babies, and even middle class people from Mexico who intend to go back to Mexico come to American hospitals to give birth for that reason. (This group pays their own way.)

I think the law should be changed since this is clear 'gaming' of the laws, but I don't like messing with the Constitution. Maybe we should just do away with the 'family reuinification' principle allowing permenant residents and citizens to bring family if their parents weren't born here. That would at least mean the parent couldn't use the baby to leverage themselves in when the baby turns 21.

People can be so stupid verymuch all the time. NOT refering to you) Any child, no matter the parents nationality will become a US citizen. Haters should just stop babblin about wether or not babies should have become citizens, because we are not native to this country. Only native americans should be able to say who goes and who stays. And I can tell you right now, that most gringos would be leaving on the May Flower.

We're just a piece of FREE meat to illegal aliens. Why should we feel sympathetic about an illegal alien with an anchor baby? If you break the law, you should be prepared to live with the consequences... The 14th Amendment was not a grant of citizenship! It did not confer citizenship! It merely defined citizenship and the manner by which it could be obtained.

The Constitution says that any, “Any child born to a ‘LEGAL’ immigrant shall be a naturalized citizen.”

Nowhere does it say ‘illegal’. Point blank!

No Amendments apply to illegal aliens. “Fraud destroys the validity of everything into which it enters” Nuud V. Burrows, 91 U.S. 426 This means no 14th Amendment Protections.

The Federation for American Immigration Reform says taxpayers spend $12 billion a year on primary and secondary school education for children here illegally. Another $17 billion for the American-born children of illegal aliens, known as anchor babies.

America values birth right citizenship to aliens that LEGALLY enter the United States. Americans do not want to support illegal immigrants sneaking across the boarders taking advantage of Americas public assistance, housing and education and medicare programs.

These illegal anchor babies are a burden to the American society. Taxpayers do not want to support them or their parents. These anchor babies should not be granted citizenship just because their parents broke federal laws getting here.

Under current law, a child born on U.S. soil, despite the legal status of his or her parents, is entitled to all benefits that U.S. citizenship entails, including federal welfare benefits and the right to vote. When that child turns 21, he or she is able to sponsor his or her entire family so they may have legal status in the United States.

Miller and his supporters hope to change this practice.

“More than 120 nations, including Germany, Japan and Italy, do not grant automatic citizenship to children born to illegal immigrants,” said Miller. “The United States must wise up and join the rest of the industrialized world in acknowledging that caring for, educating and integrating unregulated waves of immigrants is not sustainable.”

Unfourtanly The answer is yes . We are working to change that law so you can't cross the boarder and have a kid that tax payers have to take care of.
