I am a citizen and my boyfriend is illegal. He is from Guatemala and came here for the sole reason of working here. He wants to go back but i want to know how he can be legalized. If we get married in the US will it be harder for him? What if we get married over there? He doesn't want to stay here because he is scared of being deported and he's right. I just want to do it the legal way.

If he goes back before you two are married you are screwed. It will be almost impossible to get him back legally. If you get married over there he still has to stay there until the US gov't approves his "spouse" visa to come back. That can take years. If he goes back to Guatemala & you apply for a fiance visa for him the gov't will deny it based solely on the fact he over-stayed his previous work visa. If you are serious about marrying this guy you need to do it now and then file the appropriate paperwork. He will get a valid work permit almost immediately but it usually takes 2 or 3 years for the greencard.

You can file a fiancee petition once he is back in Guatemala,asking for him to be sent here in lew of marriage,or you can have him get a passport and enter legally,then marrying him here where he can immediatly file to stay here.There is also the option of marrying him in Guatemala then filing to have him go with you to U.S.I think the passport deal would probably be the fastest way.

Spend $200 and buy yourself an hour's worth of an immigration attorney's time.

There once was a time when you could get married here, apply for change of status, and be allowed to wait in the US while the paperwork was processed. I've been told they aren't allowing it anymore.

Has he filed and paid income tax each year he's been here? That issue will come up in the process.

If he went back to Guatemala you could go there, marry him, come back and apply for a visa for him as your spouse. That would take about 6 months to process and cost less than $1,000 for all the paperwork.

marry HIM IF U ARE IN LOVE. His problems with immigration will be waived. It will take more time, but proving that you have a real marriage, can make it work. Viva o amor!

If you want to marry an illegal, you need to marry him in his counrty. Once your married in Guatemala, live in Guatemala. He shouldn't become a US citizen unless he speaks English or is very serious about learning it and puts effort into it. And if he does become a citizen, he can't send money back to Guatemala.

let the illegal go back, you can join him, he should be scared of being deported, the united states is finally waking up!!

Yak Rider is wrong ... it is still perfectly possible to get married here and "wait out" the change of status .. it's done all the time ... with the proviso of course that the person is here legally to begin with ...

He needs to leave US and come back in legally via a visa....You can get married here, and start the process of sponsoring him as his spouse....You have to show at least 3 years of income, to show you can support him...And it will cost you around 3k.....It can be done, it just takes time, commitment and some money...

This is how me and my husband did it...Best of luck...

you have to get married overthere an then ask for some kind of papers that show you two are married and want to live here if you look aroun you will find out good luck!!!

One of my customers did it, it was just a matter of paying the appropriate fees and filling out immense amounts of paperwork.
