my brother recently got into a tussel and it ended up in him being blindsided by another kid of the age 17 and he punched him in the face while wearing a ring with a spike on it. the spike was lodged in my brothers forehead and a plastic surgen took out most of it but the other part is too close to a nerve for him to take it out

Anybody can sue anybody for practically anything. Whether you win or not is another question. Depends on the evidence and circumstances.

No you can not sue for damage done to your brother. And since he is 17, his parents would have to be the ones to sue.

Also he needs to go to another doctor since very little nerves can not be repaired in the face area.

Can YOU sue? or can your brother sue?

You can sue for almost anything, including the act you describe. You might even win, even if no criminal charges are proven (ask OJ). Collecting on the judgement might be another matter tho.

You can sue for almost anything. Whether or not you will win is another. Then there is the matter of actually collecting against the judgement.
