Im 19yrs. old a on 10.13.06 while on the freeway,I was cut off by another vehicle. I slammed on the brakes so the man would not hit me, my car skidded and hit the wall of the free way head on. My car bounced off made a complete circle and the rear of my car hit the wall again. My car was totaled. According to the manuel they should have gone off if my airbag indicator light came on everytime I turn on my car, it does.The car is a 2002 Nissan Sentra GXE. My mother and I are consedering sueing, my question is should I? If so for how much and would I even win?

You can sue but you would lose.

The airbag system is designed to go off when it feels the impact is a threat to the driver. Cars are designed to have a majority of the energy dissipated to different areas of the car.

The airbags essentially have a mind of their own. If the driver has a large amount of the energy that will go towards him, the airbags deploy...

If not, there are thousands of other safety items you are not aware of that just protected you.

By the way, were you hurt? If not, then your car obviously protected you well. If so, the airbags may have made it worse if they deployed.

Everyone calls me to tell me they are suing these companies, good luck.

I recently had a customer with a 2005 nissan Sentra that rear ended a dump truck at 40mph and died as the airbag struck him in the head causing his neck to break and he died.

Sometimes they are good, sometimes not.

I am a claims adjuster.

I would ask the folks in the Law section of the Site. Politics & government> Law and Ethics. But it does seem like a pretty good case. If the system was working correctly then they should have gone of. However what you need to determine is WHO to sue. Did they not go of because of a faulty sensor? Did they not go off because of a defect in the gas module? Did they not go off because of the type of impact? There is a lot to factor in. I would find out WHY they did not deploy first before you Sue. Then you will know who to sue. As far as how much, I don't think you could get much if you where not hurt. That’s where you would need to talk to a lawyer. Find out what recourse you have on that. But I would find out why they did not deploy before you go farther on this issue.

First of all did you buy this car new? Second who has serviced it? There are a lot of disreputable people out there that remove or disable airbags on cars because they are very expensive to replace. Some people remove the fuse to disable them deliberately.
Get all the facts before you try and sue. You could end up with egg on your face. The car companies can afford bigger and better attorneys than you can. Just make sure you have all your ducks in a row before you sue.

Alot of times airbags are removed from used cars and sold in after market or black markets. Have the air bags inspected. If they are not there or have been replaced by something other than the original manufacture's equipment you have good grounds to sue the people you bought the car fromm. Also contact Nissan ASAP, they will send an investigator. Don't dilly dally, be proactive, be GUNG HO!!!!!!!!!!!

feel free to start contacting lawyers, call them and explain the situation, but if i were you, i would be driving a new nissan every year on the companies dollar!!!!!!! sue the crap outta them. and critics say american cars suck, at least our airbags deploy( even if its when we just hit a pothole, they still deploy!)

there must be substantial damage to the front of the car that it feels theres a threat and needs to go off. You will %99.9 lose this case

i would sue them very badly. that's pitiful they didn't deploy. any lawyer would have a field day with that. good luck
