Hi, My mom has been denied Family leave for me at her job due to not being able to have specific dates when she'll be out. I have crohn's disease and im frequently sick. She's worked at her job for the given amt of time to apply for it and she had a doctor's certificate. Plz help me, i need to know is this legal and if not i need documents stating this. Thanx

I don't know of dates having to be provided to be covered under FMLA. She should check out the Department of Labor website. Wrongly denying an employee can be a serious offense.

It is not legal to deny Family Leave for a certified family illness. I would have her go immediately to the Human Resources department of her company and reapply for the leave. If that still doesn't work she needs to contact the state Industrial Commission.

My husband is diabetic and he had to have a form filled out for his past employer stating that he may need up to 3-5 days off for no more than 3wks (just an example) in a year. This was great because is he had a bad problem with his diabetes then he wouldn't get into trouble from his employer. I say have your mom look into it at work........the human resources dept.

I'm pretty sure that a company is not required to give you any amount of sick time or "family leave" by law. They have to give you holiday pay if you work on a holiday, but other than that I think you might be SOL.

I am not sure. Because when I used my family leave I had dates.
Tell your mom to talk to them about why she doesn't have any dates sets and that might help her. Sorry I couldn't be more help.

i'm not sure call your local unemployment office, i think, or with the doctor... but i think you are able to take it but it has to be for a length of time and you don't get paid for it... i also know if she has a doctors note they can't fire her, i'm pretty sure of it... check under... www.familyleave.com or www.familyleaveact.com...
