It depends. FMLA only applies to companies of a certain size (used to be more than 25 employees in one location).

And FMLA does not mandate that the employer pay you anything, it just says they have to hold your job for you.

It is also limitied to 12 weeks a year, so if you took all 12 weeks off to have a baby, or took it for some other reason, the employer does not have to hold your job for more time off if the child is sick.

And the "sick" child must be under a doctors care, the sickness can't be routine, such as colds, flu, chicken pox, etc.

FMLA does not require paid time, only time off. Next not all businesses are under the law, and you have to have worked there so long and meet other noification rules.

Most places have thier poster posted in the HR section, take time to read it or look it up on the internet

Next it is not for a day here or a day there when you call in that morning, you would have to take a extended time away for a seroius illness

The only legal way your employer can deny you pay is if you have used all or a half of you vacation time...then they do not have to pay you from there on....they can not deny you your FMLA time that you have requested...by law you are required to tell them that you are requesting FMLA leave and how many hours, days or weeks....nothing more is needed...if they deny you then that is awhole lot of trouble for them...

Is the fmla for you, or your child's illness? If you have it for your depression or something, using it to take care of a sick child isn't allowed. You don't have to give them a reason though. If you call off using fmla, they can't question you as to why. You can say that it's personal.

Yes. The employer can require that you take it unpaid, (the law only requires that they give you unpaid leave). They do not have to let you use up any other type of paid time off unless your illness qualifies for paid leave according to your employers HR Policy and local laws.

The time is guaranteed to you under the law. The pay, however is not. That is based upon the policy of the company.

They can't deny you documented medical leave for yourself or family. However, they do not have to pay you.

They can, but would not have a leg to stand on. Unless, you have already used up all of your alloted time.
