to sell it from my backyard out of the garage?So far we have brewed 50 kegs at 30 gallons each and plan to convert the garage into a bar and we believe it will do well, everyone likes the beer better than the commerical beer because its richer and stronger than the commerical.

Hahah well...YES you do need it but, seriously if you're just selling it to friends I wouldn't get one.

If you start selling it commercially, obviously yes you really do need it. If you convert the garage into a bar you will need liquor licenses blah blah, and make sure that this is okay within your neighborhood. Many neighborhoods have rules and regulations and I doubt your neighbors would want 40 people in your garage yelling and being loud at 1 am.

As long as your state allows home production you are fine...UNTIL you decide to try and sell it. The point where your move from hobbyist to 'beer entrepreneur' you will fall under both state and federal laws that regulate [i.e. prohibit] you from selling your brew without appropriate licensing and adherence to regulations defined by the FDA. And on top of that, you become subject to paying taxes on not just the sale, but the production of the beer itself. Probably best to start by finding a friendly distribution channel that you can let people try it for free, build up the demand, and then follow with all the necessary licensing once you are certain it will be worth the effort. My cousin makes wine here in California and went through the same thing. You will need State and Federal licenses and permits if you are going to sell or distribute your beer. It is also taxed in addition to the permits. You are also breaking the law in brewing the amount that you are brewing if it exceeds 100 gallons of beer per year in your household.

26 USCS § 5051(a)(1) provides for the imposition and rate of federal taxation on beer in the United States.

(a) Rate of tax.
(1) In general. A tax is hereby imposed on all beer brewed or produced, and removed for consumption or sale, within the United States, or imported into the United States.
26 USCS § 5053(e) provides exemptions from federal taxation for beer brewed for personal use.

(e) Beer for personal or family use. Subject to regulation prescribed by the Secretary, any adult may, without payment of tax, produce beer for personal or family use and not for sale. The aggregate amount of beer exempt from tax under this subsection with respect to any household shall not exceed
(1) 200 gallons per calendar year if there are 2 or more adults in such household, or
(2) 100 gallons per calendar year if there is only 1 adult in such household.

You are brewing 30 gallon batches at home? All grain? I'm surprised that someone with the brewing knowledge that allows them to brew 30 gallon batches and kegging in wooden casks, doesn't know basic Homebrew laws.

You do need a licence (at least in the UK) as otherwise you'd be defrauding HM Customs and be in BIG trouble.

There are also the Health & Safety factors to take into account. What if you poisoned someone (or lots of people!)?

There is a way whereby people can buy the containers and get the beer for free, however. But that's dodgy as well!

Pu-leeze...there's no way you have 50 thirty gallon wooden barrels in your garage.

Besides, even if this were true, the TTB would be knocking on your door tomorrow morning for selling in a residence, making more than allowed by law without paying taxes, and a host of other things you've already violated.

Each state has differnet laws regarding making alcoholic beverages. In OK, you have to have a permit to make wine and cider even for your own use! Check on the web for your state alcohol board and go from there. If you do need a permit to brew, you can probably get the form on the net! To sell, you most likely do have to have a license!!!

all depends on how much beer you made here in virginia you can make about as much as you stated for personal use. but i wouldnt worry . have youre party. just dont let the beer get to old kegs dont last that long even if ya keep emm cold.
