Some of the answer may depend on the state you live in, but most should be the same no matter what state this is happening in. First, if your brother broke the lease early, there MAY be a claim for additional months' rent after he left until the owner could re-rent the apartment. That could be the primary reason for the large amount of the claim. Second, you should talk with the personnel or payroll department of your employer (well, whoever handles payroll, anyway) and get a copy of whatever document they are relying on to do the garnishment. If there is a Court Order for garnishment, there will be a caption showing who sued, in what court and in what case number. If there is not a court order - there should be no garnishment. I have seen some smaller employers honor an attorney's letter requesting garnishment without insisting on a court order - this is illegal. Then you should go to the court that issued the order, talk with someone in the civil clerk's office and ask to see the file. My guess is that you didn't answer the Complaint (probably because you didn't receive it) and judgment entered against you by default. If that is what happened, you may need to hire an attorney to file a Motion to Vacate the Judgment - and be ready to prove that you were not served with the original Complaint. Beyond that, you should have gotten a Motion for the garnishment, to give you the opportunity to present any defenses or objections to the garnishment - you need to see why that didn't happen, either. It sounds like someone is really playing games with the court system - I hope you catch the bas--rd and nail 'm to the wall!

I'm presuming you're in the UK so it breaks down like this. Points on your licence stay on there for 3 years under the totting up scheme - ie. 12 points and you get a ban, but the endorsement will stay on your licence for 4 years, its mainly insurance companies that benefit from the 4 year thing, it allows them to fleece you for more money for a year longer than the points can count towards a ban.

However this depends on the nature of the endorsement, if someone is caught drink driving then unless its changed since it happened to someone i know that endorsement stays in place for 10 years.

Valid for 3 years and removeable after 4, in the case of Drink Driving Valid 10 years removable after 11

The points on your driving license apply for 3 years,however you are not permitted to have them removed until 4 years after the motoring offence.Then you must send your license to the d.v.l.a.This is not the end of the story as all insurance companies will ask you if you have had any driving convictions within the last 5years,unfortunately you must give the truthfull answer or they have the right to cancel your insurance in the event of a claim

It is different for Department of Motor Vehicles/Secretary of State vs. Insurance Companies.

In Michigan, the points will drop off after 3 years, but the tickets still shows for 5 years. The insurance companies usually look at the full 5 years for rating.

They stay on your licence for 4 years but count for 3 years for 'totting up' purposes to be disqualified when you have 12 points

In the UK the points count for 12 months and you can have them removed after 3 years.Insurance companies generally ask about the convictions over a 5 year spread. If you want to have your spent points taken off your license you will need to send it to the DVLA at Swansea.

As a fellow sufferer it is three years for speeding or such and you can send off to the dvlc, if you are lucky there are some counties which run a scheme whereby you go for a day of tuition at thier site this will get you pionts off, one being Dorset held at Winfrith
